ALLEGED SHIPMENT: On or about December 8, 1943, by the Freshman Vitamin Co., from-Detroit, Mich. PRODUCT: 3 cartons, each containing 10,000 liver, iron, and vitamin Bi capsules, and 197 bottles, each containing 100 capsules, at Flushing, Long Island, N. Y. The product had been shipped in cartons, and a portion had been repackaged by the consignee into bottles. LABEL IN PART: (When shipped) "Formula 57 Liver .Iron & Vitamin Bj Capsules"; (portion repacked) "Zillifer B Capsules." VIOLATIONS CHARGED: Misbranding, Section 403 (j), when introduced into interstate commerce, the article purported to be a food for special dietary uses by man, by reason of its vitamin Bi and iron content, and its label failed to bear, as required by the regulations, a statement of the proportion of the minimum daily requirement for vitamin Bi and iron supplied by a specified quantity of the article when consumed during a period of 1 day. DISPOSITION: August 17, 1944. No claimant having appeared, judgment of condemnation was entered and the product was ordered destroyed.
