LIBEL FILED : January 3,1945, Southern District of Florida. ALLEGED SHIPMENT: On or about September 26 and October 9, 1944, from Crowley, La. PRODUCT: 907 100-pound bags of rice at Jacksonville, Fla., in the possession of the Daylight Grocery Co., Inc. This product was stored, after shipment, under insanitary conditions. The bags were rodent-gnawed, and rodent pellets and urine stains were observed on the bags. VIOLATION CHARGED: Adulteration, Section 402 (a) (4), the product had been held under insanitary conditions whereby it may have become contaminated with filth. DISPOSITION: January 22, 1945. The Daylight Grocery Co., claimant, having admitted the allegations of the libel, judgment of condemnation was entered and the product was ordered released under bond for separation of the fit from the unfit portion, the latter to be denatured for use as animal or poultry feed, under the supervision of the Food and Drug Administration.
