LIBEL FILED : August 3, 1945, Northern District of Ohio. ALLEGED SHIPMENT : Between the approximate dates of October 10 and December 1,1944, by Rockwood and Co., from Brooklyn, N. Y. PRODUCT: 10 bags, each containing 20 10-pound slabs, of sweet chocolate at Cleveland, Ohio. LABEL IN PART: "Stratford Sweet Chocolate." VIOLATION CHARGED: Adulteration, Section 402 (a) (3), the product consisted in whole or in part of a filthy substance by reason of the presence of insect fragments and larvae. DISPOSITION: August 17, 1945. The Shoot Chocolate Co., Cleveland, Ohio, claimant, having admitted the allegations of the libel, judgment, of condemna- tion was entered and the product was ordered released under bond, conditioned that it be cleaned to remove all filth, under the supervision of the Food and Drug Administration; and that, if such cleaning were impracticable, it be dis- posed of for purposes other than human consumption.
