INFORMATION FILED: July 18, 1945, Western District of Missouri, against the Concordia Creamery Co., a corporation, Concordia, Mo. ALLEGED SHIPMENT : On or about June 15,1944, from the State of Missouri into the State of Kansas. LABEL IN PART : "Pasteurized Missouri Cheddar Cheese." VIOLATIONS CHARGED: Adulteration, Section 402 (b) (2), a product containing more than 39 percent of moisture and less than 50 percent of milk fat had been substituted for Cheddar cheese. Misbranding, Section 403 (e) (1), the product failed to bear a label contain- ing the name and place of business of the manufacturer, packer, or distributor; and, Section 403 (g) (1), it failed to conform to the definition and standard of identity for Cheddar cheese, since it contained more than 39 percent of moisture and its solids contained less than 50 percent of milk fat. DISPOSITION : August 9, 1945. A plea of guilty having been entered on behalf of the defendant, the court imposed a fine of $50 on each of 2 counts, a total fine of $100 and costs.
