PRODUCT: 249 cases, each containing 48 cans, of oysters at Hilo, T. H. LABEL IN PART : "Tropical Brand * * * Cove Oysters." NATURE OF CHARGE : Adulteration, Section 402 (a) (3), the article was in whole or in part filthy, putrid, decomposed, and otherwise unfit for food. DISPOSITION: March 6, 1944. The American Factors, Ltd., claimant, having admitted that a portion of the product was decomposed, judgment was entered condemning that portion and ordering it destroyed. The remainder of the product was found by the court to be fit for human consumption, and it was ordered returned to the claimant.
