The jars contained an average of 24.17 ounces avoirdupois of drained kraut. Jars of this size should contain a minimum of 28 ounces avoirdupois of drained kraut. LABEL, IN PART : (Jar) "L and B Quality Sauerkraut * * * Contents 36 Fl. Ozs." NATURE OF CHARGE: Adulteration, Section 402 (b) (2), brine had been substi- tuted in part for sauerkraut. Misbranding, Section 403 (d), the container was so filled as to be misleading; and, Section 403 (k), the article contained a chemical preservative, sulfur dioxide, and it failed to bear labeling stating that fact. DISPOSITION : March 12, 1946. No claimant having appeared, judgment of con- demnation was entered and the product was ordered destroyed.
