LIBEL FILED : January 23,1946, Northern District of Illinois. ALLEGED SHIPMENT: On or about August 25, 1945, by the Riverview Canning Corporation, from Fall River, Wis. PRODUCT: 1,774 cases, each containing 24 1-pound, 4-ounce cans, of peas at Chicago,, Ill. LABEL IN PART: The cans were unlabeled when shipped. They were being labeled: "Way Ahead Wisconsin Early Peas * * * Packed by River- view Canning Corp., Fall River, Wis." The cases were stenciled "St. 3 Alaska." NATURE OF CHARGE: Misbranding, Section 403 (h) (1), the product was sub- standard in quality; Section 403 (e) (1), it failed to bear a label containing the name and place of business of the manufacturer, packer, or distributor; Section 403 (e) (2), it failed to bear a label containing an accurate statement of the quantity of the contents; and, Section 403 (g) (2), the label failed to bear, as required by the regulations, the name of the food specified in the defi- nition and standard of identity for canned peas. DISPOSITION: March 1, 1946. The.Riverview Canning Corporation, claimant, having admitted the facts in the libel, judgment of condemnation was entered and the product was ordered released under bond to be relabeled under the supervision of the Food and Drug Administration.
