ALLEGED SHIPMENT : On or about December 17,1945, by the Three Ribbons Pack- ing Co., from Mountain View, Calif. PRODUCT: 85 cases, each containing 24 1-pound jars, of spaghetti with mush- room sauce at Seattle, Wash. LABEL IN PART: "3 Ribbons • Spaghetti With Mushroom Sauce." NATURE OF CHARGE: Adulteration, Section 402 (b) (1), a valuable constituent, mushrooms, had been omitted from the product. Misbranding, Section 403 (a), the label designation, "Spaghetti with Mush- room Sauce," was false and misleading since the product contained no detectable amount of mushrooms. DISPOSITION : August 9, 1946. The Three Ribbons Packing Co., claimant, having consented to the entry of a decree, judgment of condemnation was entered and the product was ordered released under bond to be relabeled under the supervision of the Food and Drug Administration.
