10201. Misbranding of 505 Fermentation Inhibitor. TJ. S. v. IS Bottles of 505 Fermentation Inhibitor. Default decree of condemnation and destruc- tion. (F. D. C. No. 16140. Sample No. 28746-H.) JJIBEL FILED : June 22,1945, Western District of Washington. ALLEGED SHIPMENT : On or about September 22 and December 10,1943, and Jan- uary 8 and September 28,1944, by the Sethness Products Co., from Chicago, Ill. PRODUCT: 18 1-gallon bottles of 505 Fermentation Inhibitor at Seattle, Wash. J^ATTJEE OF CHARGE : Misbranding, Section 403 (a), the labeling of the article was misleading since the name "505 Fermentation Inhibitor" in combination with the label statements, "Contains: Water, Acetic Derivatives, Food Acids and 755525-—48- 423 esters and ethers of Monochloracetic acid. Use: To be used in Acid products to prevent lactic and alcoholic fermentation and the growth and multiplica- tion of yeast bacteria," created the impression that the article was wholesome and suitable for use as a component of food used by man. The article con- tained monochloracetic acid, which is a poisonous and deleterious substance, and its labeling failed to reveal the material fact, in the light of such representa- tion, that the article contained a poisonous and deleterious substance which would render it unwholesome and unsuitable for use as a component of food used by man. DISPOSITION : March 25, 1946. No claimant having appeared, judgment of con- demnation was entered and the product was ordered destroyed.
