ALLEGED SHIPMENT: On or about June 21, 1946, by the S. A. Moffett Co., Inc., from Mount Vernon, Wash. PRODUCT: 95 cases, each containing 12 2%-pound cartons, and 200 cases, each containing 36 14-ounce cartons, of frozen spinach at Camden, N. J. Both lots of the product contained excessive added water, and one lot contained • weeds and'grass. LABEL IN PART : "Polar Frosted Foods Spinach." NATURE OF CHARGE: Adulteration, Section 402 (b) (2), water, weeds, and grass had been substituted in part for spinach; and, Section 402 (b) (4), water had been added to the article so as to increase its bulk and weight, and weeds and grass had been mixed and packed with a portion of the article so as to reduce its quality. DISPOSITION: December 9, 1946. No claimant having appeared, judgment of condemnation was entered and the product was ordered destroyed.
