ALLEGED SHIPMENT : On or about July 5 and 18 and August 9,1945, from Belleville, 111. PRODUCT: 96 100-pound bags of enriched flour at Baltimore, Md., in possession of the Great Atlantic and Pacific Tea Company. The product was stored under insanitary conditions after shipment. Some of the bags were rodent- gnawed, and rodent excreta and urine stains were observed on them. Ex- amination showed that the product contained larvae and cast skins. NATUEE OE CHARGE: Adulteration, Section 402 (a) (3), the article consisted in whole or in part of a filthy substance; and, Section 402 (a) (4), it had been held under insanitary conditions whereby it may have become contami- nated with filth. DISPOSITION : January 2, 1946. The Great Atlantic and Pacific Tea Company claimant, having admitted the allegations of the libel, judgment of condemna- tion was entered and the product was ordered released under bond for de- naturing and conversion into stock feed, under the supervision of the Food and Drug Administration.
