NATURE OF CHARGE: Adulteration, Section 402 (a) (4), the article had been pre- pared, packed, or held under insanitary conditions whereby it may have be- come contaminated with filth. DISPOSITION: December 10, 1945. The Kelly Creamery, claimant, having con- sented to the entry of a decree, judgment of condemnation was entered and the product was ordered released under bond to be disposed of for purposes other than for human consumption, under the supervision of the Food and Drug Administration.
