ALLEGED SHIPMENT : On or about April 30 and May 15,1945, by the R. J. Spitz Co., from New York, N. Y. PRODUCT: 9 135-pound bags of poppy seed at Phila. Pa. Examination showed that the product was white poppy seeds artificially colored bluish-black with logwood. The artificially colored seeds simulated in appearance the bine- colored poppy seeds, which have greater commercial value. LABEL IN PART: "British India Poppy Seed Artificially Colored With Vege- table Extract." NATURE OF CHARGE: Adulteration, Section 402 (b) (3), inferiority had been concealed by the addition of logwood, an artificial color; and, Section 402 (b) (4), logwood had been added to the article so as to make it appear better or of greater value than it was. DISPOSITION : January 3, 1946. No claimant having appeared, judgment of con- demnation was entered and the product was ordered destroyed.
