ALLEGED SHIPMENT: Between the approximate dates of November 2 and 30, 1945, by the Eavey Co., from Xenia, Ohio. PRODUCT: 46 cases, each ^containing 24 1-pound, 3-ounce cans, 122 cases,'each containing 48 10 ounce cans, and 88 cases, each containing 24 1-pound, 3-ounce cans, of tomato puree at Richmond, Ind. Examination showed that the product contained decomposed tomato material. LABEL IN PART: "Ma-Co Tomato Puree * * * Packed by The McCoy Canned Food Company Urbana, Ohio," or "Merrit Brand Tomato Puree." NATURE OF CHARGE: Adulteration, Section 402 (a) (3), the product .consisted in whole or in part of a decomposed substance. DISPOSITION: March 29, 1946. The sole intervener having consented to the entry of a decree, judgment of forfeiture was entered and the product was ordered destroyed.
