ALLEGED SHIPMENT : On or about June 4,1946, by the Irving Manaster Co., from Chicago, Ill. PRODUCT: 96 boxes, each containing approximately 100 pounds, of hen turkeys at Philadelphia, Pa. NATURE OF CHARGE: Adulteration, Section 402 (a) (3), the product consisted in whole or in part of a filthy and decomposed substance by reason of contamina- tion with fecal matter and the presence of decomposed poultry; and, Section 402 (a) (5), it was in whole or in part the product of a diseased animal. DISPOSITION : On July 22, 1946, Food Fair Stores, Inc., Philadelphia, Pa., claim- ant, having admitted the allegations in the libel, judgment of condemnation was entered and the product was ordered released under bond to be brought into compliance with the law, under the supervision of the Food and Drug Admin- istration. On July 29,1946, an amended decree was entered ordering the product shipped to an evisceration plant to be eviscerated, the fit portion to be canned and the unfit portion to be destroyed under the supervision of the Food and Drug Administration.
