LIBELS FILED : September 20, 1946, District of Massachusetts. ALLEGED SHIPMENT : On or about September 5 and 9, 1946, by Green Mwitain Dairy Products, Inc., from Burlington, Vt. PRODUCT: 51 boxes and 20 boxes, each containing 75 pounds, of butter at Somer- ville, Mass. NATURE OF CHARGE : Adulteration, Section 402 (b) (2), a product containing less than 80 percent by weight of milk fat had been substituted for butter. DISPOSITION: October 29, 1946. The National Creamery Co., Inc., Somerville, Mass., having appeared as claimant, and having consented to the entry of a decree, and the cases having been consolidated, judgment of condemnation was entered. The product was ordered released under bond for conversion into butter fat for use in the manufacture of ice cream, under the supervision of the Federal Security Agency.
