ALLEGED SHIPMENT : On or about September 12,1945, by the Consolidated Pecan Sales Co., from Albany, Ga. PRODUCT: 46 50-pound bags of unshelled pecans at Minneapolis, Minn. LABEL IN PART: "King Cole Pecans," or "Klondyk Graded Paper Shell PeKans." NATURE OF CHARGE: Adulteration, Section 402 (a) (3), the article consisted in whole or in part of a filthy and decomposed substance by reason of the presence of insect-infested, moldy, and decomposed peKans. DISPOSITION : March 17, 1947, amending decree of November 13, 1946. Jack Sacks, St. Paul, Minn., claimant, having consented to the entry of a decree, judgment of condemnation was entered and the product was ordered released under bond for the purpose of shelling and segregating the good portion from the bad, under the supervision of the Federal Security Agency.
