ALLEGED SHIPMENT : On or about July 30,1946, by Golden Gate Products, from Oakland, Calif. PRODUCT: 692% cases, each containing 6 cans, of apricots at Seattle, Wash. LABEL IN PART: "Gold Coast Whole Unpeeled Apricots in Light Syrup Net Contents 6 Lb. 10 Oz." NATURE OF CHARGE: Misbranding, Section 403 (h) (2), the product failed to meet the standard of fill of container for canned apricots, since there was not present in the container the maximum number of optional apricot ingredients which could have been sealed in the container and processed by heat to prevent spoilage without crushing or breaking such ingredients; and the product failed to bear the substandard legend. DISPOSITION : June 2,1947 Golden Gate Foods, Inc., Berkeley, Calif., claimant, having consented to the entry of a decree, judgment of condemnation was entered and the product was ordered released under bond, to be repacked or relabeled, or otherwise brought into compliance with the law, under the super- vision of the Food and Drug Administration.
