ALLEGED SHIPMENT: On or about February 28, 1947, the Claremont Creamery Association delivered the product for shipment from Owatonna, Minn. PRODUCT: 107 60-pound boxes of butter at Jersey City, N. J. LABEL IN PART: "Creamery Butter The Great A. & P. Tea Co. New York Distributors." NATURE OF CHARGE: Adulteration, Section 402 (b) (2), a product containing less than 80 percent by weight of milk fat had been substituted for butter. DISPOSITION : April 14, 1947. The Great Atlantic & Pacific Tea Co., claimant, having admitted the allegations of the libel, judgment of condemnation was entered and the product was ordered released under bond, conditioned that it be reworked, under the supervision of the Federal Security Agency.
