ALLEGED SHIPMENT: On or about September 13 and 15, 1947, by the Fairmont Foods Co.. from Columbus, Ohio, and Guthrie, Okla. PRODUCT: Butter. 200 cases, each containing 12 1-pound cartons, and 100 cases, each containing 32 1-pound cartons, at Charleston, W. Va., and 20 cases, each containing 32 1-pound cartons, at Jacksonville. Fla. LABEL IN PART : "Fairmont's Better Brand Butter." NATURE OF CHARGE: Adulteration. Section 402 (a) (3). the Charleston lot con- sisted in whole or in part of a decomposed substance (the product contained excessive mold mycelia). and the Jacksonville lot consisted in whole or in part of a filthy substance by reason of the presence of insects, insect parts, and rodent hair fragments, and because it had been made from filthy cream. DISPOSITION: November 4. 1947. The Fairmont Foods Co., claimant for the Charleston lot. having consented to the entry of a decree, judgment of con- demnation was entered and the product was ordered released under bond to be disposed of in compliance with the law, under the supervision of the Food and Drug Administration. The product was converted info soap stock. On Janu- ary 2.194S. no claimant having appeared for the Jacksonville lot. judgment of condemnation was entered and the product was ordered delivered to a correc- tional institution, for use other than for human consumption.
