ALLEGED SHIPMENT: On or about October 10,1947, from New York, N. Y. PRODUCT: 23 100-pound bags of brazil nuts at Charleston, W. Va. NATURE OF CHARGE: Adulteration, Section 402 (a) (3), the product consisted in whole or in part of a decomposed substance by reason of the presence of moldy and rancid nuts, and was otherwise unfit for food by reason of the presence of empty shells. It was adulterated while held for sale after shipment in inter- state commerce. DISPOSITION : December 29, 1948. Default decree of condemnation. The prod- uct was ordered delivered to charitable institutions, for the purpose of salvaging the good portion of the product for their use.
