ALLEGED SHIPMENT : On or about October 15, 17, and 23, and November 4, 1947, by Schuler Chocolates, Inc., from Winona, Minn. PRODUCT: Candy. 8 cases, each containing 16 boxes of 24 bars each, at Des Moines, Iowa; 12 cases, each containing 12 cartons of 3 1-pound boxes each, at Great Falls, Mont.; and 15 cases, each containing 6 6-pound boxes, at New Orleans, La. LABEL IN PART : "Schuler Cherry Hill Chocolate Covered," "Schuler Park Square Chocolates," or "Vanilla Fudge Schuler Chocolates." NATURE OF CHARGE: Adulteration, Section 402 (a) (3), the article consisted in whole or in part of a filthy substance by reason of the presence of weevils, lar- vae, insect fragments, insects, rodent hair fragments, and rodent excreta frag- ments; and, Section 402 (a) (4), it had been prepared under insanitary condi- tions whereby it may have become contaminated with filth. DISPOSITION : February 12 and March 15,1948. Default decrees of condemnation and destruction.
