LIBELS FILED: June 11 and September 9, 1948, District of Minnesota and Northern District of Texas. ALLEGED SHIPMENT: On or about March 26 and May 13,1948, by the Tubbs Co, from Prescott, Wis. PRODUCT: 2 barrels of Absorbex M at Redwood Falls, Minn., and Abilene, Tex The product was used for neutralizing cream in the manufacture of dairy products for human consumption. LABEL, IN PART : (Portion) "Absorber M For Whole Milk, Skimmed Milk, Butter- milk, and Whey for Human Consumption." NATURE OF CHARGE: Adulteration, Section 402 (a) (2), the article contained an added poisonous and deleterious substance, a boron compound, which is unsafe within the meaning of the law since it is a substance not required m the production of the article and could have been avoided by good manufactur- ing practice. DISPOSITION: October 14 and 22, 1948. Default decrees of condemnation and destruction.
