ALLEGED SHIPMENT: On or about August 23, 1948, by the Finley Creamery Co., from Finley, N. Dak. PRODUCT: 12 64-pound boxes of butter at New York, N. Y. LABEL IN PART : "Butter Distributed by J. B. Kramer, Inc. New York, N. Y." NATURE OF CHARGE : Adulteration, Section 402 (b) (2), a product containing less than 80 percent by weight of milk fat had been substituted for butter. Misbranding, Section 403 (a), the label statement "Butter"' was false and mis- leading. DISPOSITION : October 7. 1948. The Finley Creamery Co., claimant, having ad- mitted the allegations of the libel, judgment of condemnation was entered and the product was ordered released under bond for reworking, under the super- vision of the Federal Security Agency.
