ALLEGED SHIPMENT : On or about October 20, 1948, by Wm. A. Higgins & Co., from New York, N. Y. PRODUCT: 100 100-pound bags of brazil nuts at Cincinnati, Ohio. LABEL, IN PART : "Holly Brazil Nuts." NATURE OF CHARGE: Adulteration, Section 402 (a) (3), the product consisted in whole or in part of a decomposed substance by reason of the presence of decomposed nuts, and was otherwise unfit for food by reason of the presence of empty shells. DISPOSITION : December 10, 1948. Wm. A. Higgins & Co., claimant, having admitted the allegations of the libel, judgment of condemnation was entered and the product was ordered released under bond, conditioned that the fit portion be segregated from the unfit portion, under the supervision of the Food and Drug Administration. Of the 9,000 pounds seized, 7,357 pounds were salvaged.
