ALLEGED SHIPMENT: On or about December 18, 1946, from San Antonio, Tex. PRODUCT: 110 bags, each containing 190 pounds, of chili peppers at St. Louis, Mo. NATURE OF CHARGE: Adulteration, Section 402 (a) (3), the product consisted in whole or in part of a decomposed substance by reason of the presence of mold. The product was adulterated while held for sale after shipment in interstate commerce. DISPOSITION: April 7, 1949. The Jas. H. Forbes Tea & Coffee Co., claimant, having consented to the entry of decree, judgment of condemnation was en- tered. The court ordered that the product be released under bond to be brought into compliance with the law, under the supervision of the Food and Drug - Administration. The salvage operations resulted in the release of 19,638 pounds of cleaned peppers.
