ALLEGED SHIPMENT : On or about August 24, 1948, from the State of Tennessee into the State of Mississippi. LABEL IN PART : "Dyer Brand Hand Packed Tomatoes." NATURE OF CHARGE: Adulteration, Section 402 (a) (3), the article consisted in part of a filthy substance by reason of the presence of fly maggots and fly eggs, and it consisted in part of a decomposed substance by reason of the presence of decomposed tomato material; and, Section 402 (a) (4), the article had been prepared and packed under insanitary conditions whereby it may have become contaminated with filth. DISPOSITION : July 8, 1949. A plea of nolo contendere having been entered, the court imposed a fine of $500.
