ALLEGED SHIPMENT : On or about July 30,' 1948, from New York, N. Y. PRODUCT: 119 cases, each containing 48 15-ounce cans, of sardines at Louis- ville, Ky. NATURE OF CHARGE: Adulteration, Section 402 (a) (3), the product consisted in whole or in part of a decomposed substance by reason of the presence of decomposed sardines. The product was adulterated while held for sale after shipment in interstate commerce. DISPOSITION : June 17,1949. Default decree of condemnation. The court ordered that the product be delivered to a charitable institution, for use as animal feed.
