ALLEGED SHIPMENT: On or about June 9, 1949, by the Knoxville Dairy, from Knoxville, Iowa. PRODUCT: 51 64-pound cartons of butter at New York, N. Y. LABEL, IN PART : "Butter Distributed by W. W. Elzea Inc. New York." NATURE OF CHARGE: Adulteration, Section 402 (b) (2), a product containing less than 80 percent by weight of milk fat had been substituted for butter. Misbranding, Section 403 (a), the article was labeled "Butter," which was false and misleading since it contained less than 80 percent of milk fat. DISPOSITION: July 6, 1949. The Knoxville Dairy, claimant, having admitted the allegations of the libel, judgment of condemnation was entered and the product was ordered released under bond for reworking, under the supervision of the Federal Security Agency.
