ALLEGED SHIPMENT : On or about September 29, 1949, by the Herrman-McLean Co., from Monroeville, Ohio. PRODUCT: 113 5-pound sacks of corn meal at Farmington, W. Va. LABEL, IN PART : "Ohio Fancy Corn Meal." NATURE OF CHARGE: Adulteration, Section 402 (a) (3), the article consisted in whole or in part of a filthy substance by reason of the presence of rodent excreta, rodent hairs, insects, and insect fragments; and, Section 402 (a) (4), it had been prepared under insanitary conditions whereby it may have become contaminated with filth. DISPOSITION : November 5, 1949. Default decree of condemnation and destruc- tion. Destruction of the product was effected by delivering it to a public institution, for use as animal feed.
