ALLEGED SHIPMENT: On or about August 14 and 18, 1948, from the State of Oklahoma into the States of Texas and Louisiana. LABEL IN PART : "Fairmont Creamed Cottage Cheese Manufactured by Fair- mont Foods Company" and "Creamery Butter Packed expressly for L. Frank & Co., Inc., New Orleans, La." NATURE OF CHARGE: Adulteration, Section 402 (a) (3), the products consisted in part of filthy substances by reason of the presence of (in the cheese) insects, insect fragments, a rodent hair, a cow hair, and plant fragments resembling manure, and (in the butter) insects, insect eggs, insect fragments, rodent hair fragments, and feather barbules; and, Section 402 (a) (4), they had been prepared under insanitary conditions whereby they may have become con- taminated with filth.
