ALLEGED SHIPMENT: On or about February 7 and 14, 1949, by the Sun-Eayed Co., from Frankfort, Ind. PRODUCT: 809 cases, each containing 48 13-ounce cans, and 422 cases, each containing 12 46-ounce cans, of tomato juice at New York, N. Y. LABEL, IN PART: (Can) "Kemp's Sun-Rayed Brand Pure Tomato Juice." NATURE OF CHARGE: Adulteration, Section 402 (a) (3), the article consisted in whole or in part of a decomposed substance by reason of the presence of de- composed tomato material. DISPOSITION : July 7,1949. Seggerman Nixon Corp., New York, N. Y., claimant, having consented to the entry of a decree, judgment of condemnation was entered and the court ordered that the product be released under bond for segregation and destruction of the unfit portion, under the supervision of the Federal Security Agency. The segregation operations were completed on or about September 6, 1949, and resulted in the destruction of approximately 98 cases of 13-ounce cans and 328 cases of 46-ounce Kans.
