LIBEL FILED : October 11,1949, Northern District of Georgia. ALLEGED SHIPMENT : On or about August 10 and September 2,1948, from Chicago, 111. PRODUCT: 194 100-pound bags of Soyabits (ground soybeans) at Atlanta, Ga., in possession of the Atlanta Service Warehouse. NATURE OF CHARGE: Adulteration, Section 402 (a) (3), the article consisted in whole or in part of a filthy substance by reason of the presence of insects, rodent excreta, and rodent hairs; and, Section 402 (a) (4), it had been held under insanitary conditions whereby it may have become contaminated with filth. The article was adulterated while held for sale after shipment in interstate commerce. DISPOSITION : November 14, 1949. The Glidden Co., Cleveland, Ohio, claimant, having consented to the entry of a decree, judgment of condemnation was entered and the court ordered that the product be released under bond for conversion into stock feed, under the supervision of the Federal Security Agency.
