ALLEGED SHIPMENT: On or about October 31, 1949, by The Great A & P Tea Co., from New York, N. Y. PRODUCT: 600 cases, each containing 25 1-pound bags, of mixed nuts at Scranton, Pa. LABEL IN PART: "Sun-Glo Extra Fancy Mixed Nuts * * * Packed By Wm. A. Higgins & Co., Inc., New York, N. Y." NATURE OF CHARGE: Adulteration, Section 402 (a) (3), the article consisted in whole or in part of a decomposed substance by reason of the presence of moldy and otherwise decomposed brazil nuts. DISPOSITION : December 29,1949. Wm. A. Higgins & Co., Inc., claimant, having admitted the allegations of the libel, judgment of condemnation was entered and the court ordered that the product be released under bond for segregation and destruction of the unfit portion, under the supervision of the Food and Drug Administration. The segregation operations were completed on or about April 13,1950, and resulted in the destruction of 300 pounds of the 1,725 pounds of brazil nuts which were included in the 6,075 pounds of mixed nuts which were seized.
