ALLEGED SHIPMENT : On or about September 24,1949, by the Orleans Seafood Co., from New Orleans, La. PRODUCT: 99 cases, each containing 48 5-ounce cans, of shrimp at San Francisco, Calif. LABEL IN PART: (Can) "Gulf Pearl Brand Shrimp Wet Pack." NATURE OF CHARGE: Adulteration, Section 402 (a) (3), the product consisted in whole or in part of a decomposed substance by reason of the presence of decomposed shrimp. Misbranding, Section 403 (h) (2), the product was packed in nontrans- parent containers and fell below the standard of fill of container for canned wet pack shrimp in such containers since the cut-out weight of the shrimp taken from each can was less than 64 percent of the water capacity of the con- tainer, and its label failed to bear a statement that the product fell below the standard. DISPOSITION : April 11, 1950. Default decree of condemnation and destruction.
