ALLEGED SHIPMENT : On or about January 13 and 14, 1950, by A. Shrier & Sons Co., from Jasmin, Calif. PRODUCT: 896 crates of celery at Denver, Colo. LABEL IN PART : "Good Morning Brand Vegetable." NATURE OF CHARGE: Adulteration, Section 402 (a) (3), the product was unfit for food by reason of its discoloration, pithiness, and softness, due to freezing. DISPOSITION: March 22, 1950. The shipper having consented to the entry of a decree, judgment of condemnation was entered and the court ordered that the product be sold to C. H. Robinson Co., Denver, Colo., conditioned that the celery be reprocessed so that it would be fit for human consumption, under the supervision of the Food and Drug Administration. The fruit-damaged outer stalks were removed, resulting in the salvage of 341 crates of celery hearts.
