ALLEGED SHIPMENT: On or about March 15, 1950, by Hunt Foods, Inc., from Campbell, Calif. PRODUCT: 99 cases, each containing 24 1-pound bags, of dried apricots, and 99 cases, each containing 24 1-pound bags, of dried pears at Cleveland, Ohio. LABEL IN PART: (Bags) "Hunts California Extra Selected Dried Apricots [or "Pears"] * * * Packed by Guggenhime & Co. Division of Hunt Foods, Inc., San Francisco California." NATURE OF CHARGE: Adulteration, Section 402 (a) (3), the products consisted in whole or in part of filthy substances by reason of the presence of insects, insect fragments, rodent hairs, and, in addition, (apricots only) rodent excreta; and, Section 402 (a) (4), the products had been prepared under insanitary conditions whereby they may have become contaminated with filth. DISPOSITION: October 19, 1950. Default decree of condemnation and destruc- tion.
