NATURE OF CHARGE: Adulteration, Section 402 (a) (3), the article consisted in whole or in part of a decomposed substance by reason of the presence of decomposed birds; and, Section 402 (a) (5), the article was in whole or in part the product of a diseased animal, or of an animal which had died other- wise than by slaughter. DISPOSITION : February 13, 1951. Default decree of condemnation and destruc- tion. On February 23,1951, the decree was amended to provide that a number of birds be delivered to the Food and Drug Administration, and that with respect to the remainder, the fit portion be segregated and delivered to chari- table institutions and the unfit portion be destroyed.
