ALLEGED SHIPMENT : On or about October 13 and 31, 1950, by Baker & Williams, Inc., from New York, N. Y. PRODUCT: 128 cartons, each containing 24 1-pound bags, of brazil nuts at Jersey City, N. J. LABEL IN PART: (Bag) "Cliff House Selected Hand Picked Brazil Nuts." NATURE OF CHARGE: Adulteration, Section 402 (a) (3), the product consisted in whole or in part of a decomposed substance by reason of the presence of moldy nuts, and it was otherwise unfit for food by reason of the presence of rancid nuts. DISPOSITION : .December 12,1950. The Biddle Purchasing Co., New York, N. Y., claimant, having consented to the entry of a decree, judgment of condemna- tion was entered and the court ordered that the product be released under bond, conditioned that the nuts be cracked and that the unfit be segregated and destroyed, under the supervision of the Food and Drug Administration. Of the total amount seized, 3,072 pounds, 715 pounds were found to be good and were released.
