ALLEGED SHIPMENT : On or about October 21, 1949, from the State of New York into the State of Connecticut. LABEL IN PART: "Marlon Chocolate Double Dipped Strawberries in Cor- dial." NATURE OF CHARGE : Adulteration, Section 402 (b) (2), the labels of the product indicated that the candy contained whole strawberries, when, in fact, arti- ficially colored grapes had been substituted. Misbranding, Section 403 (i) (2), the product was fabricated from two or more ingredients, and its label failed to declare the presence of one of the ingredients by its common or usual name, i. e., grapes.
