INFORMATION FILED : May 8,1951, District of Delaware, against Diamond State Poultry Co., Inc., Lewes, Del. ALLEGED SHIPMENT : On or about July 9, September 20, and November 18, 1950, from the State of Delaware into the State of New York. NATURE OF CHARGE: Adulteration, Section 402 (a) (3), the article consisted in part of a filthy substance by reason of the presence of birds contaminated with dirty, extraneous, and fecal matter, and it consisted in part of a sub- stance otherwise unfit for food because of the presence therein of extensively bruised poultry; Section 402 (a) (4), the article had been prepared under insanitary conditions whereby it may have become contaminated with filth; and, Section 402 (a) (5), (2 lots) the article was in part the product of a diseased animal and was in part the product of an animal which'had died otherwise than by slaughter. DISPOSITION : May 21, 1951. A plea of guilty having been entered, the defend- ant was fined $2,250.
