ALLEGED SHIPMENT : On or about December 20, 1950, from Plymouth, N. C. PRODUCT: 25 100-pound bags of peanuts at Sioux City, Iowa, in the possession of the Tolerton & Warfield Co., Sioux City, Iowa. NATURE OF CHARGE : Adulteration, Section 402 (a) (3), the product consisted in whole or in part of a filthy substance by reason of the presence of rodent excreta ; and, Section 402 (a) (4), it had been held under insanitary conditions whereby it may have become contaminated with filth. The product was adul- terated while held for sale after shipment in interstate commerce. DISPOSITION : July 21, 1951. The Tolerton & Warfield Co., Sioux City, Iowa, claimant, having consented to the entry of a decree, judgment of condemnation was entered and the court ordered that the product be released under bond for segregation of the fit portion from the unfit, and that the unfit portion be destroyed or converted into animal feed or otherwise brought into compliance with the law, under the supervision of the Federal Security Agency. Segrega- tion operations resulted in the release of 22y2 bags of peanuts as fit. Each of these bags contained approximately 95 pounds.
