ALLEGED SHIPMENT : On or about March 1,1951, by Joe Cohen, from Yarmouth, Maine. PRODUCT: 3 crates, each containing 12 head, of New York dressed poultry at Boston, Mass. NATURE OF CHARGE: Adulteration, Section 402 (a) (3), the product consisted in whole or in part of a filthy substance by reason of the presence of birds contaminated with fecal matter; and, Section 402 (a) (5), it was in whole or in part the product of a diseased animal or of an animal which had died otherwise than by slaughter. DISPOSITION: April 23, 1951. Default decree of condemnation. The court ordered that the portion that was fit for human consumption be segregated by the United States marshal, under the supervision of the Food and Drug Administration, and delivered to a charitable institution, and that the unfit portion be destroyed. Approximately 36 birds were seized, and of these, 7 were salvaged as fit and the remainder were destroyed.
