ALLEGED SHIPMENT : On or about February 5, 1951, by the Muro Importing Co., from Brooklyn, N. Y. PEODTTOT: 14 cases, each containing 24 %-ounce bottles, of black pepper at Hillside, N. J. LABEL IN PART: (Bottle) "Muro Pure Black Pepper." NATURE OF CHARGE: Adulteration, Section 402 (b) (2), a mixture of black pepper, buckwheat hulls, and salt had been substituted in whole or in part for pepper. Misbranding, Section 403 (a), the label statement "Pure Black Pepper" was false and misleading since the product was a mixture of black pepper, buck- wheat hulls, and salt. DISPOSITION: April 30, 1951. Default decree of condemnation. The court ordered that the product be delivered to charitable institutions after examina- tion by the Food and Drug Administration to determine whether the product was suitable for human consumption.
