ALLEGED SHIPMENT: On or about November 28, 1949, by the Mancini Products Co., from New York, N. Y. PRODUCT: 20 cartons, each containing 6 cans, of blended olive and peanut oils at Newark, N. J. LABEL IN PART: (Can) "Mancini Deluxe Pure 50% Olive 50% Peanut Oil Contents One Gallon." NATURE OF CHARGE: Adulteration, Section 402 (b) (1), a valuable constituent, olive oil, had been in part omitted from the article. Misbranding, Section 403 (a), the label statement "50% Olive * * * Oil" was false and misleading as applied to an article which contained less than the declared amount of olive oil. DISPOSITION: August 20, 1951. Christopher Mancini, trading as the Mancini Products Co., claimant, having consented to the entry of a decree, judgment of condemnation was entered and the court ordered that the product be released under bond for the purpose of repacking and/or relabeling, under the supervision of the Federal Security Agency.
