ALLEGED SHIPMENT: On or about July 15, 1952, by Bert Henry & Sons, from Dunning, N. Dak. PRODUCT: 1 carload of wheat at Minneapolis, Minn. NATURE OF CHARGE: Adulteration, Section 402 (a) (2), the article contained an added poisonous and deleterious substance, a mercurial compound, which is unsafe within the meaning of the law since it is a substance not required in the production of the article and can be avoided by good manufacturing practice. DISPOSITION : August 13, 1952. The Farmers Union Grain Terminal Associ- ation, St. Paul, Minn., claimant, having consented to the entry of a decree, judgment of condemnation was entered and the court ordered that the product be released under bond for the purpose of removing the flax which had been found to be in the product and for reprocessing the wheat by scouring, under the supervision of the Federal Security Agency. The wheat was separated from the flax, with the result that, out of the 77,520 pounds contained in the railroad ear, 21,940 pounds were found to - consist sir wheat. This wheat was reprocessed by scouring, * with the-result thai? 710 pounds of the product were found unfit and were destroyed.
