PRODUCT: 247 cases, each containing 24 1-pound, 13-ounce cans, of tomato puree at South Boston, Mass. LABEL IN PART: (Can) "Blue Sky Fancy California Concentrated Tomato Puree Contents 1 Lb. 13 Ozs." NATURE OF CHARGE: Adulteration, Section 402 (a) (3), the product consisted in whole or in part of a decomposed substance by reason of the presence of decomposed tomato material. Misbranding, Section 403 (e) (2), the product failed to bear a label contain- ing an accurate statement of the quantity of the contents since the cans con- tained less than the labeled "1 Lb. 13 Ozs." DISPOSITION : April 15,1953. Default decree of condemnation and destruction.
