ALLEGED SHIPMENT : On or about May 5, 1952, by the Robin Pharmacal Corp., from Brooklyn, N. Y., to Cleveland, Ohio, where the product was refused by the consignee and returned to the manufacturer. PRODUCT: 50,700 Cal-D-Fer tablets in 2 drums at Brooklyn, N. Y. NATURE OF CHARGE: Adulteration, Section 402 (b) (1), a valuable constituent, vitamin D, had been in whole or in part omitted or abstracted from the article. Misbranding, Section 403 (a), the label statement "Each Tablet Con- tains: * * * Vitamin D * * * 300 Unit" was false and misleading since the article contained less than the declared amount of vitamin D. DISPOSITION : May 19,1953. Default decree of condemnation and destruction. The cases reported herewith were instituted in the United States district courts by the United States attorneys, acting upon reports submitted by the Department of Health, Education, and Welfare.
