NATURE op CHARGE: Adulteration, Section 402 (a) (3), the product consisted in whole or in part of a filthy substance by reason of the presence of live and dead insects. The product was adulterated while held for sale after shipment in interstate commerce. v Ulm;K DISPOSITION: August 26, 1952. Schwabach & Co., NewfYork, N. Y.; claimant, having consented to the entry of a decree, judgment of'Cbnddihnatioh WaS en- tered and the court ordered that the product be released under bond 'to be fumigated, reprocessed, and repacked tmder the supervision of the Fe^ral Security Agency. 31,384 pounds of cocoa beans were salvaged and 449 pounds were destroyed.
