ALLEGED SHIPMENT : On or about September 24, 1952, from Portales, N. Mex. PRODUCT: 429 115-pound bags of shelled peanuts at Seattle, Wash., in the possession of the Olympic Warehouse & Cold Storage Co. NATURE OF CHARGE: Adulteration, Section 402 (a) (3) the article consisted in whole or in part of a filthy substance by reason of the presence of rodent excreta, rodent urine, and rodent-gnawed peanuts; and, Section 402 (a) (4), it had been held under insanitary conditions whereby it may have become con- , taminated with filth. The article was adulterated while held for sale after shipment in interstate commerce. DISPOSITION: May 25, 1953. The Olympic Warehouse & Cold Storage Co., claimant, having consented to the entry of a decree, judgment of condemna- tion was entered and the court ordered that the product be released under bond for the purpose of sorting and segregating, under the supervision of the Department of Health, Education, and Welfare. As a result of the seg- regation operations, 1,499 pounds of the product were found unfit and were denatured for use as hog feed.
